my terms and conditions
Below are the terms and conditions of my services ("T&Cs"). They govern our legal relationship. All references to "I", "me", and "my" are references to myself personally and to any of my employee(s), agent(s), partner(s) and/or contractor(s) relating to the T&Cs below.
-
I will provide professional translation and interpretation services to you.
-
My services include marketing translations, website translations, document translations, live interpretations, correspondence and liaisoning.
Contract -
The T&Cs apply to every single service provided by me and every single order you place.
-
When placing any orders or instructions, you fully understand and accept each provision of the T&Cs.
-
A contract is formed between you and me when you place an order and I accept it in any form (preferably in writing).
-
I will quote you a price and an expected time to complete the work, and no contract will be formed between us until we both approve the order.
-
Unless you tell me otherwise, I have the right to publicise my work for you as my customer.
Cancelling a contract -
You may cancel any contract between us at any time by giving me a written notification.
-
If you are cancelling the contract between us, I reserve the right to recover translation and/or other associated costs for the work completed for you. This will be, for example, for the percentage of the work completed at the time of cancellation.
-
I may also cancel the contract between us by submitting a written notification to you.
-
If I am cancelling the contract between us, I will not charge anything for the part of the completed work. I may provide you with any translated products at my complete discretion.
-
The contract between us is considered cancelled if one of us breaks any of the provisions of the T&Cs and fails to rectify the breach within 5 days of being notified (by the other party) of the breach.
Limitation of liability -
I will not be liable for any losses, direct or indirect, caused by the late delivery of the promised services, or by the usage of the provided services by you, or by the interruption of services or by the interruption of the accessibility to this website.
-
You will indemnify me for any losses, direct or indirect, that I may be liable for against any third party as a result of providing my services to you.
-
Notwithstanding any of the foregoing provisions, if, for any reason, I am found liable by any competent authority for any losses incurred to you relating to my provision of services, then my liability is limited to the price you and I agreed relating to the provision of those services in dispute.
Privacy policy -
I may collect personal information from you, including information about your name, contact information, your interaction with me, billing or purchase information.
-
I may collect such information from you to provide translation and other related services.
-
You have the right to ask for a copy of any personal information I hold about you, and to ask for it to be corrected if you think it is wrong. If you’d like to ask for a copy of your information, or to have it corrected, please contact me at kimberlynz@hotmail.com, or 64-21-164-3062.
Non-commercial use and copyright -
Everything on this website, including texts, images, banners, and links are for private usage only.
-
You cannot modify, sell, reproduce or share any of the contents of this website without my prior consent.
-
My work for you (the end product) is yours and so the T&Cs do not apply to them. The translations belong to you right after they are delivered to you.
-
Subject to clause 7, after delivering any end products to you, I lose any copyright privileges on them.
Accessibility -
I do not guarantee the continuous and uninterrupted access to this website.
-
I also reserve my right to discontinue my services.
-
In case of any unexpected interruption, I will use my best efforts to notify all existing clients with ongoing work.
Dispute -
Any dispute(s) connected with the T&Cs or my services to you are governed by the laws of New Zealand. New Zealand courts and tribunals shall have the non-exclusive jurisdiction over any such disputes.
